Mettler-Toledo International Inc. Privacy Policy for California Consumers

This Privacy Policy for California Consumers ("Privacy Policy") supplements the information contained in Mettler-Toledo International, Inc.'s (“METTLER TOLEDO”, “we”, “us”) General Privacy Policy and applies to any consumers residing in the State of California ("consumers" or "you") who visit our website located at www.mt.com (the “Site”). This Privacy Policy also applies to personal information we collect from California consumers, if any, through email communications, our online channels (including other websites, online shops, mobile applications, and social media websites that reference this Privacy Policy, here ("MT Online Channels") and to personal information you provide us offline, e.g. at trade shows or sales exhibitions, when you place an order over the phone, or when you contact our customer service. This Privacy Policy does not apply to any consumers residing outside California. Consumers residing outside California should refer to the General Privacy Policy. 

We adopt this Privacy Policy to comply with the California Consumer Privacy Act of 2018, as amended (CCPA) and any terms defined in the CCPA have the same meaning when used in this Privacy Policy. Where applicable, this Privacy Policy controls in the event of a conflict with the General Privacy Policy or our other policies unless expressly stated otherwise therein. For example, we may provide alternative policies that control with respect to our employees.

While we have provided this Privacy Policy as part of our effort to fully and transparently comply with our understanding of the specific requirements of the State of California under the CCPA, our actions in doing so do not change the primary purpose of this Site. As stated in the General Privacy Policy, this Site and, the other MT Online Channels, are intended only for business, professional and academic visitors and their organizations. This Site is not intended for general public consumers.

You acknowledge and agree that in visiting this Site or using another MT Online Channel, you are acting either in the capacity of (i) a job applicant to, an employee of, owner of, director of, officer of, medical staff member of, or contractor of METTLER TOLEDO; or (ii) an employee, owner, director, officer, or contractor of a company, partnership, sole proprietorship, non-profit, or government agency, in which case your communications or transaction with METTLER TOLEDO via the Site or other MT Online Channel will occur solely within the context of conducting due diligence regarding, or providing or receiving a product or service to or from such company, partnership, sole proprietorship, non-profit, or government agency, and on whose behalf you also accept and agree to the terms of this Privacy Policy, the General Privacy Policy, and the Terms of Use for the Site, as they may be modified by METTLER TOLEDO from time-to-time and posted on this Site.

Length of time METTLER TOLEDO intends to retain each category of personal information it collects:

  • METTLER TOLEDO retains the personal information it collects only as reasonably necessary for the purposes described in this notice or otherwise disclosed to you at the time of collection. The length of time varies depending upon the circumstances, including the type of information, purposes of collection, and applicable compliance, risk management and legal obligations. (For example, METTLER TOLEDO will retain your transactional data for as long as necessary to comply with our tax, accounting, compliance, risk management and recordkeeping obligations, as well as an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with legal obligations.

  • To initiate, perform, and manage contractual relationships, e.g. by accepting and processing orders, performing transactions, processing payments, accounting, auditing and billing, arranging shipments and deliveries, and providing repairs and support services;
  • To communicate with you about products, services, events, surveys, and promotions, e.g. by notifying you about changes in our services or by sending you marketing communications;
  • To improve, enhance, or expand the products, services and METTLER TOLEDO Online Channels offered by METTLER TOLEDO (for example, to provide better information, products, and special offers);
  • To maintain and protect the security of our products, services, and METTLER TOLEDO Online Channels, to prevent and detect security threats, fraud, or other criminal or malicious activities;
  • To make suggestions and recommendations to you and other users of our Site about goods or services that are of interest to you or them;

METTLER TOLEDO will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

METTLER TOLEDO does not sell your personal information; however, we may share your personal information, which the CPPA defines as disclosing personal information to third parties for cross-context behavioral advertising.

We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except for performing the contract.

METTLER TOLEDO has neither used nor disclosed sensitive personal information in the prior 12 months.

Your Rights and Choices 

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that METTLER TOLEDO disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
       - sales, identifying the personal information categories that each category of recipient purchased; and
       - disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained. 

Deletion Request Rights

You have the right to request that METTLER TOLEDO delete your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see section directly below on Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either: 

  • Calling us at 1-877-658-1566 (toll free); or
  • Filling out this Website Form and inserting your email address.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We reserve the right to request additional information or actions from you in order to assist us in verifying your identity or authority to make the request. You may be required to complete an additional form to verify certain personal information and send this form to METTLER TOLEDO at the postal address listed in "Contact Information" below.  

Making a verifiable consumer request does not require you to create an account with us. However, requests made through your password protected account may help streamline and speed up the verification process when the request relates to personal information associated with that specific account.

We will only use personal information you specifically supply for verification proposes to verify your identity or authority to make the request. 

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (additional forty-five (45) days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

Opting-Out of Sharing of Personal Information 

You have the right to direct us to not share your personal information at any time (the "right to opt-out"). To exercise this right to opt-out, you (or your authorized representative) may submit a request to us by visiting the online form here.

You may opt out from direct marketing emails by clicking the "unsubscribe" link included in all our marketing emails. You may also anytime free of charge request to opt-out from direct marketing communications or exercise any other data subject right available to you under the applicable data protection laws, by contacting us via the Contact Information below.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Site Changes to Our Privacy Policy

METTLER TOLEDO reserves the right to amend this Policy at our discretion and at any time. When we make changes to this Policy, we will post the updated Policy on the Site and update the Policy's effective date. You are encouraged to check back frequently for changes. Your continued use of our Site following the posting of changes constitutes your acceptance of such changes.
