A Malaysian perspective on Pattern Approval

Starting from the 1st of July 2022, under The Weights and Measures ACT 1972 (Act 71), The Ministry of Domestic Trade and Consumer Affairs (abbrev. KPDNHEP) will enforce the pattern approval law for weighing and measuring instruments used for trade purposes.

Failure to comply may result in a fine or imprisonment.

In Malaysia, the Weights and Measures Department of KPDNHEP tests all measurement instruments annually to ensure accuracy. When an instrument passes this test, it can be "stamped" as legal-for-trade. As of July 2022, for an instrument to be stamped by the Weights and Measures Department; it must first be Pattern Approved. Pattern approval (or type approval) for these weighing and measuring instruments can be obtained from the custodian, the National Measurement Standards Laboratory (NMIM-SIRIM).

What is Pattern Approval?

Pattern approval is a process whereby an impartial body examines the pattern (design) of an instrument to ensure its quality, ability to retain its calibration over a range of environment and operating conditions, and inability to facilitate fraud.

How does Malaysia Pattern Approval differ from Legal-for-Trade stamping?

The KPDNHEP Weights and Measures Department (W&M) annually tests and stamps all measurement instruments used to buy or sell products by weight in Malaysia. The physical verification and stamping is conducted by their appointed party Metrology Corporation Malaysia Sdn Bhd (MCM) and DE Metrology Sdn Bhd (DM), who represents the interests of the W&M legal metrology authority within KPDNHEP and NMIM organizations and forums concerned with metrology, standardization, testing, certification and verification/stamping.

Beginning July 1. 2022, W&M will only stamp instruments that are Pattern Approved. In other words, alongside the annual verification process, W&M's appointed party would need to see that the said instrument is Pattern Approved (certified by NMIM-SIRIM) before stamping.

Who should apply for Malaysia Pattern Approval?

For example, in weighbridge or truck scale application, where trade transaction occurs based on the weight of the truckload; the weighbridge structure, load cell, scale indicator and software (when applicable) must be Pattern Approved. Who should apply for verification and stamping?

This is an annual process in which the users can reach out to their service provider for the required legal-for-trade stamping.

How does Malaysia Pattern Approval impact your business?

As is, stamping is only feasible for measurement and weighing equipment that passes the required tests by the W&M Department. As of July 2022, for an equipment to be stamped by W&M, it must also be Pattern Approved.

Some examples of measurement and weighing equipment are: truck scale/weighbridge, weighing scale, jewellery scale and retail scale.
